Atelier 30 Buyer Terms and Conditions

Welcome to Atelier 30. These terms and conditions apply to all buyers purchasing art through our e-commerce platform. By making a purchase, you agree to these terms and conditions, which align with the Australian Consumer Law to ensure a fair and transparent experience.
1. General
1.1 Atelier 30 is a platform connecting buyers with emerging artists. The artworks listed are sold directly by the artists, with Atelier 30 facilitating the transaction.
1.2 By placing an order, you confirm that you have read, understood, and agreed to these terms.
2. Artwork Description and Representation
2.1 Atelier 30 strives to ensure that all artwork descriptions, dimensions, and images are accurate and true to the original work. However, slight variations in colour or appearance may occur due to screen settings.
2.2 Buyers are encouraged to contact Atelier 30 for additional details about the artwork before purchasing if needed.
3. Pricing and Payment
3.1 All artwork prices are listed in AUD and include GST where applicable.
3.2 Shipping costs are calculated and displayed during checkout as an additional charge.
3.3 Payments must be made in full at the time of purchase. Atelier 30 accepts credit card,and PayPal payments at this time.
3.4 Atelier 30 reserves the right to adjust prices, shipping fees, or other costs without notice for future transactions.
4. Shipping and Delivery
4.1 Shipping costs are calculated based on the artist’s location, the buyer’s destination, and the dimensions/weight of the artwork. These costs will be clearly outlined at checkout.
4.2 Artists are responsible for securely packing and shipping artworks to buyers within 7 business days of payment clearance.
4.3 Buyers will receive tracking information once the artwork has been shipped. Delivery times may vary depending on the artist’s location and the courier.
4.4 In the event of delays, Atelier 30 will assist buyers and artists in resolving shipping-related issues.
5. Returns and Refunds
5.1 Under Australian Consumer Law, buyers are entitled to a refund or replacement if the artwork:
- Is not as described or differs significantly from its description.
- Arrives damaged or faulty due to inadequate packaging.
5.2 Buyers must notify Atelier 30 of any issues within 48 hours of receiving the artwork by providing detailed photos and a description of the problem.
5.3 Refunds for change of mind are not accepted unless agreed upon by the artist.
5.4 If a refund or return is approved, the buyer is responsible for returning the artwork in its original condition and packaging. Return shipping costs may apply unless the return is due to an error or fault on the part of the artist or Atelier 30.
6. Cancellations
6.1 Orders may only be canceled if the artwork has not yet been shipped. To request a cancellation, buyers must contact Atelier 30 immediately.
6.2 Once an artwork has been shipped, cancellations are no longer possible, and the returns process will apply if applicable.
7. Intellectual Property
7.1 The purchase of artwork does not transfer copyright or intellectual property rights to the buyer unless explicitly stated in writing by the artist.
7.2 Buyers may not reproduce or use the artwork for commercial purposes without the artist’s permission.
8. Limitation of Liability
8.1 Atelier 30 acts as a facilitator and is not liable for any disputes between buyers and artists, including but not limited to shipping delays, artwork condition, or descriptions.
8.2 Atelier 30 will, however, work to mediate and resolve any disputes in line with Australian Consumer Law.
9. Amendments to Terms
9.1 Atelier 30 reserves the right to update these terms and conditions at any time. Buyers will be notified of significant changes before their next purchase.
10. Governing Law
10.1 These terms and conditions are governed by the laws of Australia. Any disputes arising from these terms will be subject to the jurisdiction of the courts in New South Wales.
